Gitmo Detainees

The courts have ruled that 'Club Gitmo' detainees have constitutional rights. If I were a commander in the field, my inturpitation of the decision would be, "Take no Prisoners"!

Ric I agree, this was a deplorable use of the our court system. First of all these are not American citizens, second, they are not under the Geniva Accord. For the court to tell the military how to conduct themselfs is one of the largest missuses of there "power". Don't forget the Sargent that killed the insurgent in the mosque. Can you even emagine what would have happened if this runnaway judicial system would have gotten ahold of him. Look at the border guards sitting in prison for doing there job.

How is the court interpreting the constitution a "deplorable use" of the court system"? As the judicial arm of the government that is exactly their primary charge and responsibility.
The Constitution asserts that ..."all men are created equal, that they are endowed by their creator with certain unalienable rights..." there is no reference to rights being exclusively in the domain of American citizens.

Just as long as yours and my tax dollars don't end up paying for their defense, which I somehow gather that they will. Do you really think that their national governments will pay to defend them, let alone acknowledge that they are even citizens of their own countries? I have a feeling that the murderous bastards are going to wish they were back in club gitmo, once the courts get done with them and sentence them to one of our fine penal institutions for life. Just my opinion...

Yours and my tax dollars are paying and will pay for their defense. And before we proclaim them all guilty just for the sake of decorum and in the interest of fair play let's give them the benefit of an assumption of innocence until proven guilty.
Now I admit I'm somewhat fuzzy on the law but as I understand it for them to be convicted of a crime they would actually have to charged with a crime and in most cases this has yet to happen.

The constitution refers to "We the People of the United States". Not the people of the world. We the people of the united states choose to live under this constitution and form of government and, therefore, have responsibilities.

The detainees have not consented to be governed by the constitution. Nor have the waged war on behalf of a government. So, what are they? How to define them and what set of rules should govern our treatment of them? This is certainly an excellent question. However, it is clear that they are no more entitled to protection under the US constitution or court system than a foreign national who commits a crime in foreign country.

Maybe we should let them post bail and go home, on their personal promise to return for their day in court. I'm sure they must be law abiding non-citizens. After all, their only "presumed" alleged crime was either killing or trying to kill Americans. They are classified as enemy combatants, captured on the battle-field out of uniform and representing the flag of no country. Perhaps a little good old fashioned American justice is just what they need.

The phrase "all men are created equal..." is from the declaration of independance not the constitution. Which goes on to say that the government derives its power from 'the consent of the governed'. The detainees have never consented to be governed by the US and are therefore not entitled to the privileges of the governed.

Doug, I am a compationate person, and believe that all men are equal. This being said, I do not wish that our Judicial would go throughout the word declaring things done out of the control of the United States Constitution as wrong or right. There is or was an orginisation called the "World Court" who has no right to charge any of our citizens with any insurection. They do want to, however. It is true that the Judicial is to the checks and balance system for the executive branch, but not the comander in chief. They may look at his constitutioninality of his powers as comander in chief, however not the military. They are under the UCMJ. As eluded to, these are not a uniformed military under a countries flag. If they were, then they would be under the Geniva Accord. Being that they are an ununifored militant/insurgant group, they fall under niether the Constitution or the Geniva Accord. I have compation, as I stated, and if they are guilty, then let us exicute them, if not, let us set them free. We have set many of them free. If it is found that any of them come back to harm an American, then it is the Fedral Goverments job to protect the Citizens of the Untied States of America, and should do so with all the military might we posses.

Doug, I understand your compation on all humans as well. I am more hurt when a judge releases a know affender (esspecialy Rape or Child musistation or murder) who simply returns to commit a crime again and agian. I am in no way attacking your compation, but where is the compation for the victim, or the outrage at the person who has taken something that can never be returned, and will efect the victim and friends and family for sometimes generations to come.
I have known someone who was raped and when the scum was let go, killed herself. Where is this compation in our Judicial system?

Hope I didn't open a can of worms that I can't swallow? Good points everyone. I was just commenting from a military point of few. Why take prisoner that just may be released. 40 plus ex-club Gitmo detainees that were released, ended back on the battled field fighting our own troops again. Fortunately, this time from what I understand and read, they will not be going back to the 'Club', but are with 72 Virgins.

WOW! Can't we just talk about the Fiesta baby? Everyone should jot down a few topics in a notebook and when we're sitting around munching on BBQ ribs and red rice and drinking a few beers(Schlitz and Bud) we can pull out our notebooks and pick a topic and start screaming at each other. Just like a real fiesta.HaHaHa.But seriously folks we're gonna have a blast. Remember back in the day in the Circle we'd be playing or whatever and someone would say or do something to someone else that would really piss that person off. Sometimes we fought but then we'd go home at the the end of the day and get up the next morning and start with a clean slate and do it all over again.Just like Groundhog Day.I can smell that BBQ already aaaah!

-So I see that they are thinking of tearing down JFK because of it's decrepit, run down, structurally unsound nature and plus it's well, JFK. One of the proposals as to how to deal with the students that no longer will have this rat hole to call home is to bus them over to GW. Given this, does anyone think that these wayward students should be required to wear purple and gold uniforms? And whose responsibility will it be to see that these students are properly deloused before entering GW?
-who won (lost) the gas price challenge?
-who among us that knew Young L as one of our merry band of ne'er do wells would ever expect that he would go on to 30 years of exemplary service to the Republic
-is it wrong for me to have a laminated picture of Pat in her polka dot bikini hanging in my shower?
-what are the enviromental implications of me having my ashes scattered from the rock at Pago? Or is it more realistic for me to have someone locally just kind of chunk my ashes into the Gulf in the hope that they would somehow circumnavigate the globe and end up in Pago?

The Islanders at GW? NEVER! Why can't they just put them in some temporary trailers at Ordot. And if they do go to GW they shouldn't wear purple and gold but stripes.
Or better yet what about the baby blue uniforms the disgraced marines that got kicked out used to wear.HaHaHa.Now that would be sweet.Assholes!

Topic: The environmental impact of throwing hundreds of copies of the Pacific Daily News over the Dean's Circle cliffs, when supposedly "helping Doug" to deliver them to his faithful customers. Maybe 30 years wasn't long enough to pay the penalty for my many adolescent crimes against society. So how did the rest of you circle rats make amends for your misgivings? And I thought I was the only one with a picture of Pat in her polka-dot bikini!

Doug, my brother Steve's ashes were let loose on a Guam beach. I hope his ashes also end up at the Pago Bay Rock. I hope all of our ashes (if that is how we chose to go) end up at the 'Rock'. That seems to be the magnet of the Dean's Circle gang!

Okay I don't want to get morbid but lets try something else. Suppose you die but it's unexpected and your family is like well now I guess we need to go coffin shopping. I think your soul will end up where you would like it to go. Kind of like home is where the heart is. I don't believe in burial because what a freaking waste of land(what a thing for a Catholic to say I know). My wife wants to be cremated and have her ashes scatterad off of Pikes Peak(Americas Mountain). Believe it or not I always wanted to be buried at sea. Just wrap me up and feed the fishes. Charter a boat and drive out by the rock and feed the fishes baby.

Ric, your brothers aura is at the Pago Bay rock as someday mine will be too. Well at least I can hope.

I know a guy here in town and his dad died and he was a huge FSU fan and he wanted to have his ashes spread in the stadium and FSU officials said thanks but no thanks if we did it for him we'd have to do it for everybody blah blah. So him and a couple of his friends get a good buzz going one fine evening and proceed to see that dad's final wishes are carried out. Now I have to tell you that Campbell Stadium is something similar to the old Roman Gladiator Arenas. Solid brick with an 8 foot high fence surrounding the place. Tight security is required unfortunately to discourage rival fans (gators) vandalism sorties. So this intrepid trio goes to climbing the fence with dad's ashes and a pretty good buzz and through some minor miracle makes it to the north end zone when they're busted by security. Once the security guy determined what they were up to he basically told them to make it quick and get lost. So dad got his final wish.
Moral of the story: it's sometimes better to ask for forgiveness than to ask for permission.

Up here in Idaho, some guys say just leave me up in the mountain to feed the bear. Use me as bear bait. yea. Just ship me to Guam, throw me off the rock, and let the black tips take care of me. oh yea.

ok..you guys got me started now. mom and dad were cremated and cindy holds their ashes. we've sorta talked about whether we should spread them, but no one wants to say where or even talk about it, which is kinda sad for all of us. I really just wanted to keep some of each of them, but the boxes are sealed and can't be opened apparently.
ok...just to be clear about me..some day, hopefully, if I'm lucky. maybe I'll get 20 more years, cremate me and toss my ashes in the canal in my back yard.
